If you are a classified employee of the Hesperia Unified School District who was planning on attending Monday's school board meeting, don't take the afternoon off work and don't get a baby-sitter: The meeting is probably not happening.

The school board was to decide on which classified (non-teacher, non-management) employees would be laid off at the April 20 meeting. By law, classified employees must be notified the district will not require their services at least 45 days before the new school year starts on July 1, so the board must vote on the issue before late May.

But by law, a majority of the five-member board has to be there in order for them to vote. And three of the five members -- Hardy Black, Robert Kirk and Anthony Riley -- have all informed the district that they will miss the meeting.

"I'm going to be out of town," Kirk said Thursday. "I don't know if there's going to be [a meeting] or not."

According to California Education Code section 35164, that means the two board members who have announced their intention to attend -- Chris Bentley and Lee Rogers -- can't do much more than vote to adjourn the meeting. All of the agenda items will automatically be moved to a later date.

"There is no board policy that provides any authority to cancel a meeting," Superintendent Mark McKinney said Friday. "The position that I'm in is that this is a scheduled meeting. Even if I'm told we won't have a quorum, I can't just cancel it."

"These meetings have been established by Mr. Kirk and Mr. Black. They set the schedule," Bentley said Thursday. "I understand familial obligations, but these have been set for some time. ... Graduations are not last minute things and I do not believe family reunions are last minute things."

According to HUSD records, this is the first time since at least December 2006 that more than one board member has missed a meeting.

The school board meeting is scheduled for Monday, April 20 in the HUSD Educational Support Center Annex, 15576 Main Street. The closed session portion of the meeting begins at 2 p.m.
