VICTORVILLE An ex-deputy was sentenced to one year in jail for violating his probation after authorities found out he and his wife hadn't been sending their kids to school and had been making them live in filthy conditions.


Kelly Lee Hayes, 39, of Hesperia, accepted the prosecution's offer and pleaded no contest Thursday to one misdemeanor count of willful cruelty to a child at Victorville Superior Court. Judge Lorenzo Balderrama immediately sentenced the former Riverside County Sheriff's officer to five-year probation for that crime.


Because Kelly Hayes had two recent driving under the influence convictions, the judge on Thursday also gave him a year-long jail term. Hayes had already served 133 days in jail from his previous convictions, and has 232 days left to serve, Deputy District Attorney Dan Lough said.


Melisa Ann Hayes, 36, Kelly Hayes' wife and a Hesperia school employee, also pleaded no contest to willful cruelty to a child and was put on four-year probation. She had posted bail and been out of custody, according to court records. She won't serve any jail time.


The couple were arrested Sept. 13 after San Bernardino County Sheriff's deputies checked their Hesperia house in the 12900 block of Clovis Street. The home was in complete disarray with animal feces and urine all over the house as well as old food and dirty clothing, sheriff's officials said.


Investigators discovered that the couple's 10-year-old boy had not gone to school since April and his 12-year-old brother had missed more than 40 days of school last year. Authorities removed the children from the home.


As part of their probation terms, the couple need to take a 52-week child abuse course and make sure their kids attend school. They also have to report to domestic violence court.


Lough said the defendants have to cooperate with the county's Children and Family Services to reunite with their children.
