School board reverses course, approves agreement with teachers

Agreement clears way to bring back 76 laid off teachers, if state revenue is there

Four days after choosing not to vote on an agreement that could bring back 76 teachers laid off earlier this year, the Hesperia Unified School District school board reversed direction Friday, holding a special meeting to approve the agreement.

At Monday night's meeting of the Hesperia Unified School District school board, the board decided to delay voting on the tentative agreement between the district and the Hesperia Teachers Association teachers union that would bring back 76 elementary school teachers who had received pink slips earlier this year.

The teachers were among the 181 whom the board voted on February 23 to lay off in the 2009-2010 school year. But the salaries of these 76 were largely subsidized with Class Size Reduction funds from the state. When the board made the decision, it was expected CSR funds would be slashed. But the funds survived, and on April 10, the HUSD and HTA negotiated bringing back those teachers, covering the district's costs with a six-month freeze of automatic pay hikes for teachers, saving the district an estimated $1.2 million.

Approximately 90 percent of teachers voted in favor of the agreement, according to HTA president Jim Pace.

But three of the five board members at Monday's board meeting wanted to hold off on approving the agreement, citing concerns over the results of the May 19 election.

During the election, voters will vote on a series of propositions that, among other things, would extend the lifetime of a sales tax hike. The month will also see a revised budget released by Governor Arnold Schwarzenegger, with a subsequent recalculation of how much money the state distributes to local school districts.

(Average Daily Attendance payments, which are paid to school districts based on attendance, make up 73 percent of the HUSD's general operation fund, which pays for employee salaries and benefits.)

"I feel this is an urgent topic: There are 76 teachers whose jobs will be saved if you vote for this agreement," said Pace, the lone member of the public to address the board Friday morning. "I feel this is a good agreement for both sides."

Friday morning, shortly after 9 a.m., board member Robert Kirk moved to approve agreement, after previously leading the charge to table the agreement four days earlier.

"I appreciate [HTA vice president] Mr. Gordon Williamson and Mr. Pace getting together and working on some clarification of this agreement. It definitely helped me," said Kirk. "So that's the reason I want to move this forward."

"We do not want to commit the district to something it cannot afford," said board member Hardy Black, one of the three who voted to table the tentative agreement on Monday, along with board member Anthony Riley. Black, Kirk and Riley, along with board vice-president Lee Rogers, had all been supported by the HTA during their campaigns for office.

This time around, the board approved the agreement 4-0. (Board member Chris Bentley left the meeting early to take his children to school. He and Rogers had voted against tabling the tentative agreement at Monday's board meeting.)

If Class Size Reduction money does not remain intact, or further limits are put on the district's revenue by the state, the HUSD and HTA will go back to the negotiating table, according to the terms of the tentative agreement. The 76 elementary school teachers will not be offered their jobs back until after the May 19 election.

The next meeting of the HUSD school board will be held on Monday, May 4, at 6 p.m. in the HUSD Educational Support Center Annex, 15576 Main Street. Closed session begins at 2 p.m.

To AMEN you have to be kidding. One go around for the Swansons was enough, now you want to put them in power at the union level. Is this so she can stack the deck in favor of her husbands yet another unsuccessful bid for school board? get real people, we see through the smoke and mirrors.

Get Real, I can see that your district's service providers have forgotten who their customers are. Vote NO on these propositions and let the market correct itself. Next, we will propose school vouchers that will open the system to free markets. We are only a few steps away from this reality.

To all who have yet to vote, vote NO on all propositions. It is clear that the state and affiliated entities have mismanaged themselves and have forgotten who their customers are. You can clearly see this in the posts on this site. Let the state go into bankruptcy. If I overspent my budget the way the state has done, then I would be declaring bankruptcy. Free markets self correct and state services must return to levels supported by the inflationary/deflationary levels of our economy.

Irritated Educator, I can see why you answer these posts the way you do. You must be seriously disturbed as we DID NOT receive the survey through normal channels. The only reason we were aware of this potential change was when Mr. McKinney sent copies home with PAC members. You should stop telling people they are wrong when they clearly know what the know.

Of all the people I interviewed, no one wanted the HUSD calendar to change. The teachers wanted the calendar to change because many of them live outside Hesperia. This decision should be presented to the parents of the entire district with the appropriate reasons why one option is better than another. As the parent of two in the district, I found out about this proposed change through the PAC. As I understand the results of that survey, most of the PAC wanted the calendar to remain as it is. Case closed.

It's just so sad to see adults behaving the way our board does. Our district is the laughing stock of San Bernardino County. We were once sought after by districts throughout California and even other states. What happened? I say get out all of you. Let's start over with people who are about REAL progress.

What is wrong with Hardy Black? He seems hung up on this calendar issue which has little impact on the budget. Is ADA affected by minimum days? Couldn't classified employees continue to do their work during the full day? Why would he assume that they could just be furloughed for the afternoons on those days? Why does he seem to fall asleep during board meetings? Why does he not step down from the Board? He is doing no good for the district. Seems like he should be recalled.

Want to talk about someone who's in a snit? Pay attention to Mrs Rogers and Mr Bentley. Rogers has used nearly every moment of her new position to toss little gotcha's at kirk in particular. Like her little games at the last board meeting. Calling for a new vote on the TA because she thought kirk may have made an improper motion, only to find that no record of his motion was available for review by legal or anyone else. She was clearly trying to make kirk out to be the butt. Then her little game about how motions discussions and votes must occure, why? Between her games and Benlteys constant direct attacks on as he calls them, the voting bloc. Must he attack them during the discussion period for every motion made? You notice no new story on the website regarding the last board meeting? Because they accomplished NOTHING.

If you go to hesperia. org, you will see Hardy Black treat those on the cabinet of the school district with absolute rudeness and nastiness. I admire Mr. McKinney. I cannot ever admire a person such as that nasty Hardy Black. He's in a snit because he wanted to force the district to go to the Apple Valley calendar. He didn't get his way AGAIN, so he's being rude because he doesn't want the Elementary School to have minimum days for conferences. No thanks for your board members Jim Pace! Get rid of his designated toadies Tom Kerman and his flunky Gordon Williamson. Write in candidates.

Do the math. The freeze in step and column only saves about 30 some teachers. The rest of the 76 is based on what happens with class size reduction. We were mislead. That is why we are waiting on the election.

The teachers made at least a token effort to save their colleagues. The union had to as the teachers woke up and started demanding their union do something. They take thousands of dollars, and get a lawyer that consults with the district's lawyer because he did not do the research. There's a union vote this next week, and no teacher should vote for any of the current union people. Write in a candidate that knows what's going on, and is smart, efficient, and trustworthy. These are qualities the current union board does not have.

Hardy Black was extremely disrespectful but it is apparent he has a bee in his bonnet over the lack of support for his previous calendar changes request so he took it out on the elementary minimum day request. That said, the board made a good decision. The agreement will quite likely become void after the May 19th special election which I suspect many of the props will fail and then the subsequent May revise when the state will once again be scrambling to make cuts in education. Many teachers think they have done the right thing by giving up step and column but the requirement to make them whole after Jan 1st in addition to the understanding that any modifications to the state budget will make this agreement worthless is just making Pace look like he has actually done something. He hasn't. If ifs and buts were candy and nuts, we’d all have a Merry Christmas. It isn't going to happen. Better to deal with it now than to give those 76 hope when there isn't any.
