Recall petitions hit the streets

Proponents must gather 6,919 signatures for each of the three targeted school board members

Staff Writer

Six months after first announcing their intention to recall three Hesperia Unified School District school board members, proponents began collecting signatures outside local grocery stores this weekend.

Recall spokeswoman Lori Nielson was one of two people working the doors at Vons grocery store on Saturday morning, attempting to collect the signatures needed to call a special election that would put Hardy Black, Robert Kirk and Lee Rogers up for recall.

"Are you a registered voter in Hesperia?" Nielson asked a man emerging from the grocery store.

"I sure am."

"Would you like to sign a petition to recall three school board members?"

"Are they right-wing wackos?" he asked. Nielson, herself a conservative, focused instead of on the trio's actions, rather than ideology.

Each of the three petitions on the clipboards Nielson clutched to her chest contained an identical set of accusations against Black, Kirk and Rogers, along with responses from each board member.

Proponents allege the three, who constitute a controlling majority on the five-member board, forced former Superintendent Hank Richardson into retirement in the summer of 2007, "costing taxpayers over three hundred thousand dollars" and spent thousands on "unnecessary attorney fees" in the wrangling over who would build Oak Hills High School, among other allegations. The full list of proponents' grievances can be found online at HesperiaStar.com.

All three board members have repeatedly said the recall is without merit and is the product of "sour grapes" on behalf of former board members like Nielson, who served on the HUSD school board from 1991 to 2003. The full text of their written responses can be found online at HesperiaStar.com.

The attempt to recall Black, Kirk and Rogers briefly stalled out in late 2007. The first attempt, which began on July 23, ended on October 22, when the group failed to turn in a revised draft of the petitions back to the San Bernardino County Registrar of Voters in time to meet a deadline. The registrar approved the petitions in early December.

"I've already signed it," an older woman said, as she emerged from the grocery store.

"You have?" Nielson asked, surprised. Copies of the petition have circulated among proponents for several weeks, but have not been distributed to the general public until now.

"I sign everything my son-in-law gives me," the woman replied.

According to Nielson, recall proponents held off on collecting signatures from the public until after the school holidays ended, so that they could get off to a running start without irritating already harried holiday shoppers.

On Saturday morning at Vons, Nielson was batting .500 with the shoppers leaving the grocery store.

A man mumbled something as he shuffles past Nielson without stopping.

"He said he won't vote for anyone in California," she laughed. "We don't want you to vote for them, we want you to recall them!"

The group has less than 120 days remaining to collect approximately 6,919 signatures for each of the board members -- or 20 percent of the 34,596 registered voters living in the Hesperia Unified School District. That means gathering more signatures than the number of votes cast in 2006 for Rogers, who received 5,946, and only 45 signatures fewer than votes were cast for Black. The signatures, if gathered, would amount to just over 85 percent of the votes cast for Kirk, the top vote getter in the 2006 school board election, with 8,057 votes.

"There's three of them?" a shopper asks, as he emerges from the grocery store.

"Three of them," Nielson said, moving smoothly to intercept him. "But it'll go fast."

Recall proponents will also be collecting signatures outside other grocery stores and the Hesperia post office, as volunteers have time. The group also hopes to have two signature-collection rallies later in the spring. The completed petitions must be turned in to the San Bernardino County Registrar of Voters by April 7.

The below account should read 10s of thousands for Wagner and Pelayes, 1200 dollars alone for a private consult with Kirk on Nov 26, and hundreds as a result of Bentley every time he calls. Keep the facts, they're bad enough!

This is the third time this has been posted. Either Bentley or his School board friends keep erasing it. Bentley spends tens of thousands of dollars of school district money in fees from their attorneys, Wagner and Pelayes, by incessantly plying them with questions. The school board minutes from 28 January will reflect the unnecessary time he spent with just the lawyers answering his questions and getting billable minutes. What is not expressed is the countless number of minutes he has wasted of hours and hours of copying documents that he has demanded as well as answering his phone calls and doing unnecessary research for the questions he asks that pull administrators, secretaries, and one presumes, teachers and school personnel in his quest for someone to acknowledge how important he is. Get a JOB Bentley.

Harrasment does happen in my opinion at some school sites. Ever called your kid in sick with the flu and told you should have a Doctors note? Does one needs to have a Dr. note each time there child has a cold or flu?

At Carmel there is a family who repeatedly has head lice. They charged the district with harrassment because the health tech wanted to check their hair. Kirk Black and Lee Rogers supported the parents, not the health procedure. How long until there's a school wide infestation? What business does the school board have dictating health issues? /Doctor/ Kirk is no MD.

Of course this is about idiology. One has only to read the pro-recall comments here on HS the past months to know better. Give me a break.

Anyone else collect pull tabs from soda cans? I know dozens of kind hearted people, teachers and parents alike, that passionately collect pull tabs because they HEARD every 1000 or so tabs can be traded chemo treatments or dialysis. Ok, now we have armies of people who collect these pull tabs, has anyone HEARD where they can be turned in for a free treatment? We can see the actions taken by the board for ourselves and anyone who claimes to have HEARD the reasons from anyone other than the board or administration is at best guilty of gossip, at worst they are purposfully perpetuating false information for thier own gain.

I heard, this and that from a teacher. The school board is not the problem, it's the people who heard somthing from someone else. Everyone seems to have heard some 'fact' or another and has formed an oppion based on gossip rather than independant thought. This story points out that the petitions had not been brought out until just this weekend, yet in postings commenting on a previous story published when the petitions had been approved have someone saying they heard they had obtained 500 signatures in one day.

The raise isn't the whole problem, obviously. It's just a by product of the teachers' union running the show. I heard from a teacher that this Lee Samuels ran a fundraiser for Kirk and Black. Maybe the person posting for please should attack him instead of me.

Another reason for recall, LEE SAMUELS Education Week /1/23, Keller/ reports, /Some teachers, under a professional cloud, are paid to leave their jobs./ Such /buyouts/ are /reserved for teachers who are under suspicion of inadequate performance in the classroom or unprofessional conduct, such as yelling at parents or supervisors./ They are often used to avoid the protracted, sometimes expensive, procedures involved in removing tenured teachers in many states. Many buyout agreements /include provisions that keep information about the settlement including the complaints or accusations involved/ confidential./ However, some state legislatures and courts have moved to restrict this practice, /because such confidentiality can help teachers get new jobs and thus potentially put more students at risk./ Many observers say the practice remains fairly rare, and /lawyers for districts and union officials tend to agree that districts should strive to stay out of the buyout business./ Deliberate hiring procedures, mentoring programs and regular evaluations can help keep problems from developing in the first place. /Since every state has a two- to four-year probationary period for teachers before the protections of tenure kick in,/ experts say, /districts should not keep weak teachers who have not shown improvement./

"A big honking raise?" Please! With the rising gas prices, etc. who wouldn't be looking for a raise? But you, parent, are the problem. Screw the teachers, who cares about them, huh? As long as you have good day care, huh?

About time. Is it too late to save Mr. Richardson? Is it too late to save 6th grade schools? I know it's too late from stopping the teachers from getting a big honking raise. I guess it's good for them most of the board members are former teachers. We need some non teachers on this board!
