Honeycutt target of recall attempt

Councilman, under indictment, says he will not run for reelection

Councilman Tad Honeycutt is the target of a recall attempt.

Retired real estate broker E. T. Snell has begun the process of attempting to recall the two-term councilman, who is currently under indictment in connection with the collapse of the California Charter Academy.

"The average person doesn't even understand [the allegations against Honeycutt], and they don't want to understand," Snell said Wednesday. "And that's why we're in the mess we're in."

Honeycutt and co-defendant C. Steven Cox face 117 felony charges between them, including misappropriation of public funds, grand theft, failure to file a state tax return and filing a false tax return. Honeycutt faces up to 20 years in prison if convicted. Former CCA head Cox could get up to 64 years in prison.

The charges filed against Cox and Honeycutt last year specifically address 37 transactions in which a total of $5.5 million was transferred from the non-profit CCA to its for-profit subsidiaries. The funds were allegedly transferred without the legally required oversight from the governing board.

Once the largest chain of charter schools in the state, with 60 campuses serving 4,500 students, California Charter Academy closed its doors in August 2004, after running out of operating funds, leaving thousands of students without a classroom on the eve of the 2004-2005 school year. In an audit report commissioned by the California Department of Education and released in April 2005, CCA officials and officials in spin-off operations, like the for-profit subsidiary Everything For Schools headed up by Honeycutt, were accused of misusing $23 million in taxpayer funds.

Honeycutt's next scheduled court appearance is in August.

"How can he sit there, after what he's done?" Snell asked. "He's not going to go. He's going to sit there until the last minute."

The last attempted recall in Hesperia was aimed at three members of the Hesperia Unified School District school board. It ended on April 8, and recall proponents failed to get the signatures required to place the question of whether to recall Hardy Black, Robert Kirk and Lee Rogers on the ballot of a special election. Proponents collected just under three-quarters of the nearly 7,000 signatures needed for each board member.

Snell faces an even tougher challenge because, unlike the HUSD recall organizers, he doesn't live in the sphere of influence of the Hesperia City Council. As an Apple Valley resident, he can't gather signatures on his petition. He can't even sign it himself.

But he plans to use the Internet to get the petitions to voters, via his Web site, SBCountyRecall.com.

"Just download it off the Internet," he said. "It's up to them."

Honeycutt isn't the only elected official Snell hopes to recall: Assessor Bill Postmus, 1st District Supervisor Brad Mitzelfelt and District Attorney Mike Ramos each appear on draft petitions Snell has submitted to the San Bernardino County Registrar of Voters.

"We have guys giving their lives for this country," Snell said. "Some want to give it all, and some want to take it all."

Snell is on his third draft of his petition to recall Honeycutt, which has to be approved by Hesperia City Clerk Vicki Soderquist before it can be distributed. On it, Snell sums up his complaints against the councilman in a single phrase: "refuses to take responsibility for his actions."

By law, Honeycutt's written response must also be included on the petitions, but he chose not to give a response.

Honeycutt's term on the council ends this year. If Snell succeeds in gathering the almost 6,000 required signatures, a special election to potentially recall Honeycutt would take place in the fall, months or weeks before his term would end anyway.

"I was not planning on running again," Honeycutt said Wednesday. "I'm not really concerned either way. If he was able to get the signatures to recall me, I probably should be recalled."

As for the recall's chances, Snell said it's in the hands of the voters.

"It just depends if people want their government back," he said.

WAIT A MINUTE. Are you a former CCA or EASC employee? That would explain alot. However, your anger appears to be misplaced. According to the esteemed and oft-referenced CDE audit, said employees were treated quite well, so who should you really be directing your animosity towards?

I especially appreciated your inability to explain Aspire Public School's use of private management as "balony". It's "baloney" for those legitimatley informed. I understand your strategy. When you are unable to intelligently speak on a subject or defend your position, resort to name calling and "intentional" mispelling. As further proof of your unquestionable stance, attempt to undermine the opposing voice as being related to the accused in a pathetic attempt to undermine their credibility. I continue to be amused.

Nice reference, but I have yet to lose any argument. You continue to strengthen mine, however, with your inability to respond with accuracy or specifics. More importantly, credible evidence. You intentionally mispelled your postings? Clearly not. But nice try. You're previous posts are nothing more than ignorant rambling. Your current post is no different. Steven Cox's son was not accused of having owned or being in possesion of a Cadillac nor did the CDE audit claim he made 100 thousand a year. Where does your rambling and misinformation stem from? What is your connection to this case? Substantiate your wild claims based upon your incontrovertible evidence in this matter. The request is simple. Don't deflect. Answer the questions. We know what the allegations against the accused are. You've stated them as if they're fact. Prove they misappropriated funds. You've done a poor job thus far. Loser.

I too was purposely misspelling words. Forum Truths Number 4, The true sign of when one is losing a forum arguement is when one resorts to spell checking. You should change your name to The SpellChecker. You say the lawsuit was brought before the audit. Where is your proof? WE have heard all your lies before. The last one to bring up the Aspire School balony was Marc Steven Cox. Are you him? This would explain it all. I would feel sorry for you if it wasn't for the fact your dad stole millions of taxpayer dollars. You must be mad you lost your Cadillac and your 100 thousand dollar salary. And one more thing, loser, one of the charges against Tad and Cox is that they misappropriated funds, ie stole, from the CCA to their private company without board knowledge. Not legal terd.

An since you're so knowledgeable regarding state law and charter schools managed by private corporations, please give us some detail reagarding Aspire Public School. It was founded by Reed Hastings, a former member of the CDE who vigorously sought the closure of CCA. Please share your insight as to how this CA charter school, managed by a CMO, if you know what a CMO is, sought competitive bids before choosing a private management company. Do your homework before you answer, as I've done mine, and try to keep the childish name-calling to a minimum.

Randy, you terd head, the lawsuit you say that caused this massive conspiracy on poor Tad was brought after the audit was released. So there goes your stupid conspiracy down the drain. Maybe you SHOULD study the law. Then you might see that charter schools are governed by CA state law, ie the school cannot set up their own private company and be their own sole provider with no competitive bidding. And they cannot inflate enrollment, supply pricing, etc. All so Tad could steal millions of dollars. Randy, you must know Tad or Steve Cox personally. What other evidence do you have that has not been reported?

If you think for a minute that this whole case has anything to do with something other than political manipulation, you're delusional. The really sad part that keeps getting overlooked are the lives that were affected by greed and pride. I have never attended a day in law school, nor do I have any real-world political experience. I do know that in a lawsuit or political battle, you have to fight dirty. Go for the jugular. And the politicians in California, no doubt, are aware of that as well. You try to compete with me on my playground, I'm going to respond. You try to sue me for said response, I'm gonna pull out all the stops. If I know how to knock the wind out of your sails so-to-speak, be prepared. I would exploit your weak-spot. So here the CDE has all this power. First, get the feds to squash this insignificant pest. No go? Okay, local DA hungry to further his career. Convene a special grand jury with this provocative audit we've conducted and funded. And once you get said indictment, freeze the assets of the accused, not convicted mind you, so that the MULTI-MILLION dollar lawsuit cannot possibly continue.

NO WAY "Gomez". The CDE forced the closure of a "competitor" and are trying to pin the blame on one of the real victims. MGT did not "lie". They didn't fly black helicopters or make up stories to make the accused look bad, they just chose to or were directed to omit key elements. MGT reported on the spending habits of a private, for profit corporation. EASC was paid for their private management services by CCA. CCA was the public school. CCA received the public funds from the CDE and distributed those funds legally and contractually.

Gomez, okay YOU genius, here goes. The CDE had a lawsuit pending against them for TENS OF MILLIONS of dollars alleging they forced the closure of a viable educational program and seized the assets of a private, for profit management corporation. Pursuing such a lawsuit requires legal representation. How does someone acquire and maintain legal representation without the ability to finance said representation? Not to mention, the closure of CCA left THOUSANDS of parents and students out in the cold. Who was to blame? For sure not the CDE. Their only motive was to look out for the students who were not being served by the traditional education system. If that meant withholding funding from a program that tried to provide an alternative to a failing system, then so be it.

Beau wrote the following, "Proponents collected just under three-quarters of the nearly 7,000 signatures needed for each board member," when he should have written, "HUSD recall proponents CLAIM that they collected, etc." If I had been writing it, I would have included the fact that the laws of mathematics, and common sense, clearly demonstrate that Lori and Co. could not ever have collected anywhere near the number of valid registered voter signatures that they claim to have collected. This story needs a tuneup. And yes, the number of signatures does matter just like an accurate vote count matters. As long as stuff like this gets written, it will be challenged.

Randy, you genius, you got me on the typo. So the CDE tells MGT to fabricate the findings of the audit. Did they also tell the DA to arrest Tad and the judge to give him a 500K dollar bail. Explain this conspiracy in more detail and how the CDE can have MGT lie for them. Does it involve black helicopters and the new world order. Tad promised his own audit years ago. Where is it.
