Fire causes setback for recall effort
School board recall has been delayed about three weeks, spokeswoman says

When the Cajon Fire closed down Interstate 15 on Monday, it did more than interfere with commuters traveling to and from work. It also sent the effort to recall three Hesperia Unified School District school board members back to square one.
At the July 23 school board meeting, board members Hardy Black, Robert Kirk and Lee Rogers were served with a notice of an intention to file a recall petition. But before recall proponents could begin gathering signatures, they had to have their petitions -- including responses from Black, Kirk and Rogers -- officially certified by the San Bernardino County Registrar of Voters.
Recall proponents turned in three different drafts of their petitions and were rejected three different times for various typographical errors, including failure to italicize words or getting the number of one board member's great-grandchildren wrong. At each go-round, the registrar's office had 10 days to approve or reject the draft petitions, and then the recall group then had 10 days to submit a revised draft.
"I've been working as a registrar for 15 years, and I've been involved in several recalls, and it's not easy," said San Bernardino County Registrar of Voters Kari Verjil. "It's normal for petitions to go back and forth in the proof-reading process."
"We always turned it in on the 10th day," said recall spokeswoman Lori Nielson, herself a school board member from 1991 through 2003, "They always turned it back on the 10th day."
Monday, October 22, was the 10th day -- and deadline -- for the recall group to submit their fourth draft. And that's when the Cajon Fire got involved.
"I had the petitions in my hand, ready to go," Nielson said Wednesday. Then she got word that the California Department of Transportation had shut off I-15 going both ways. Fire and gusting winds repeatedly closed traffic going in one or both directions on Monday.
Nielson faxed and e-mailed the documents to the registrar's office. But after consulting with the county's legal counsel, the registrar's office came back with the bad news: The recall proponents had missed their deadline and would have to start over from scratch.
"According to the elections code, the proponents must turn in the original petition," Verjil said. "They have to be proofread carefully, down to the margin size, the font size. It's unfortunate that they missed that."
And so the recall effort is over, at least for the moment.
"I have been notified today that the effort to recall three Hesperia Board of Education members is dead," Rogers said in a written statement on Wednesday. "I am grateful I will not have to be distracted fighting to keep my position on the board and can focus on the many decisions that need to be made for the district."

"I guess they could start over again, but how many times do they have to fail before they decide it's a failure?" asked Mark Kirk on Wednesday. Kirk, the son of board vice-president Robert Kirk, is also the chief of staff for 4th District Supervisor Gary Ovitt. "The voice of the public was heard last November, and I think it's clear that if this were a community outpouring, [the petitions] would have been out on the street a long time ago."
"They collected money, I'm pretty sure, based on that they were going to have a recall, and I wonder if they're going to return it," said Jim Pace, president of the Hesperia Teachers Association, the union that supported Black, Kirk and Rogers, all retired or current teachers, in the last election. "The recall was based on falsehoods to begin with."
The recall committee's stated reasons for the recall can be found at their Web site, HesperiaEducationFirst.com.
There's no legally mandated cooling-off period required before the recall proponents can start over again -- if they failed to collect all the signatures required to get the question put on the ballot, they would have to wait 60 days before restarting -- but what comes next will still have to be decided by the proponents.
"Before any decision is made," Nielson said, "The committee needs to get together."
In theory, the proponents could re-serve Black, Kirk and Rogers at the November 5 school board meeting. The three would then have seven days to respond and then the process of submitting the petitions, including the responses, to the registrar for approval would begin again.
"I figure we've lost about three weeks," Nielson said.
She believes the recall has strong community support, despite the delays.
"What we're hearing is 'where are the petitions, where are the petitions?'" Nielson said.
She acknowledges the recall committee could have done things differently.
"We're not experts," Nielson said. "This is not a political machine. This is a grass-roots effort."
"It's a complicated process," Verjil said, "And that's probably why you don't see many recalls."
The Bighorn-Desert View Water Agency held a recall election in August, but before that, she said, the last successful one in San Bernardino County was took place in Highland in 2004.
Nielson said the group is still committed to removing Black, Kirk and Rogers from the school board.
"I believe in this school district and these three people are going to ruin it," she said. "They probably think this is a win for them, and it's not."

| How sad it is that Mark Kirk has to weigh in with reckless charges. His effort to demean the good name of Ms. Gogley, whom I happen to know quite well, obviously is for his own political advantage. Ms. Gogley is a concerned member of our community who has been involved as an active parent and elected official in HUSD for almost 30 years. She has shown an interest in the recall effort because she has been contacted by many people in this district questioning the conduct of the school board majority. Not only is she respected for her honest opinion, she happens to be very knowledgeable about most things educational in this town. She should be commended rather than ostracized by you or the people who have taken over control of this school district. Your attempt to question the integrity of decent people to further a destructive agenda is blatant proof of the poor position you hold in these controversial issues. For whatever it's worth, Nellie has no interest in being a candidate for the school board. Why don't you practice your own advice and talk to her instead of jumping to conclusions about things you publicize without proof or reason.
I find it very troublesome that Mark Kirk implies that we should seek his approval for school board candidates. Could it just be that Mark Kirk is letting us all know who is really running this district? |

| Actually Mark, you're incorrect. The recall has made your father and the two board members realize, maybe, that they are not to push ideas on the community, so really it may have been very successful. I've spoken to one of the parents who signed the recall, and her biggest concern was that of all community members, to let our elected officials know that they are to listen and represent us. Although surprised Ms. Nielson is part of the recall, I have seen no evidence that Ms. Gogley is. What evidence do you have? |

The right of the people to disagree with their government and petition it to resolve problems appears to be in great jeopardy here in Hesperia. | Kirk is a PhD, not a medical doctor. His proper title is Robert Kirk, PhD, but is an honorary title that he insists on ad nauseum. Not the most modest of men, certainly, but it also points to the character flaw that he exhibits over and over, to know what's best for us. Mark, now that you've come out of the woodwork /and obviously erased comments negative to you personally/, are you of a finer ilk? Represent me, not your own ideas, and give your father the same advice. You are to represent this community, not destroy ideas and programs and use a political position as a brick bat to beat those who oppose you. |

| Hesp Voter Im not against Choice Schools. I believe that they have their place just not at the expense of the 6th grade schools. I believe the administrators and teachers along with the evidence of my own kids that show the 6th grade schools produce better students than K-6 grade schools. Ive never stated Im against Choice Schools. I have not visited Victorvilles, I have however spoken to an administrator and parents. I will say I believe you are wrong about attendance. How does Victorville set up their boundaries to include the neighborhood kids, have a waiting list, and have kids from Hesperia currently enrolled. This is one of my fears about Choice Schools. If there is one child on a waiting list from Victorville and kids from outside the district are attending over a Victorville child then Victorville has FAILED to serve all the kids. If there is a waiting list then the district has failed to serve all the kids. What about the kids who dont have their own transportation. Do they get a choice. Again Im not against Choice Schools I am currently of the opinion they should be charter schools. I want to keep this short but 6th grade schools make more room at the K-5 schools and create better 7th and 8th graders. So they do benefit more than 6th grade. Nobody is going to fix the 9th grade drop out rate by trying to fix 9th graders. You have to get those at risk kids when they are younger. |

| Mrs. Lori Blewett Nielson you sure "blew it" this time. First of all not being able to get it right after three trys says it all. Second when you wait until last minute this is usually what happens. Third this is indicative of your "clueless" twelve years on the school board. Maybe now your committee of Ellen Richardson, Eric Swanson, Nellie Gogley, Bruce and Donna Minton, Helen Rogers, Jerry and Brandie Lyon can all go out to lunch together. |

| Jacob,I'm glad that you oepnly admit that you are not on the recall committee. With the exception of the 10 signers of the original petition and Mrs. Nielson no one else will admit they are involved in this. If this is such a worthwhile cause, why don't they give us their names and step up? |

| Jacob, this is Mark Kirk, I have only posted by my initials, like you. First off, I know you're angry because I've read your posts. Second, you claim that you aren't listened to by people you admit you haven't tried to speak to. That's silly. If you had tried, then fine. But you haven't. I believe this recall effort is a failure even if Lori decides to start over. Aside from the historical problems Lori and Nellie have had with this petition, now everyone knows who is behind this recall attempt. It is not to better the community, but rather a personal attack for their own political gain. People will now sit up and take notice. If Lori and Nellie continue moving forward, everyone will know that they will do anything, even tearthe community apart, in order to get elected. That's the worst type of politician there is and will not bode well for them in November. |

| Jacob, there you go again implying that the three new board members have a hidden agenda. Of course we can read the board minutes but there is more to a board member than their recorded words at a board meeting. Just look at some of the things recorded that Helen says versus what she believes. The 6th grade schools look like they solved problems for 6th graders but we are a K-12 district. Creating more 6th grade schools doesn't make up for not opening a k-6 school in over 10 years. We have a portable classroom district. That's the previous board's answer to overcrowding. You are mistaken about choice schools. Have you visited Victorville's choice schools? Yes, they have a waiting list but the are also k-6 neighborhood schools. They plan their boundaries to include the kids in their area and still have room for students who want something more! There are parents who are willing to transport their kids to a choice school. Don't deny them that opportunity. |

| Hesp Voter, if indeed Mark is Mark Kirk, I can say that he has never spoken to me. As for 6th grade schools, the three openly stated their reasons at the board meetings. Am I to believe that they held back or have other reasons that were not stated to the public? While I am a supporter of 6th grade schools, I have always wanted ALL 6th graders to have the opportunity. The previous board, based off public record, had a plan in place that would have helped overcrowding and put all 6th graders in a 6th grade only school. Since you claim they want to serve all students, how is having a choice school with a waiting list serving all students?
