School board advised to reconsider decision

Attorney makes suggestion during special board meeting on Saturday, July 14

To avoid the "appearance of impropriety," the Hesperia Unified School District school board should revisit their decision to have a relatively inexperienced firm oversee the construction of Oak Hills High School, an attorney for the district said Saturday.

Attorney Tristan Pelayes, of the Riverside-based law firm Wagner & Pelayes, made the comments during a special Saturday morning meeting of the school board. Pelayes had conferred with board members in a closed-doors session earlier in the day, and announced his recommendations when the public portion of the meeting resumed.

"I sat here when the three companies gave their concerns," Pelayes said, referring to representatives of Barnhart, Lundgren Management and Vanir Construction Management, each a company that had hoped to win the contract to build Oak Hills High School. The representatives had presented their concerns and suggestions to the board prior to the closed-doors portion of the meeting. "They've raised at least the appearance of impropriety."

At their June 19 meeting, the school board voted 3-2 to have Rancho Cucamonga-based WLC Construction Services oversee the construction of Oak Hills High School, despite the firm being rated the lowest of all the responding companies that had answered the district's request for proposals (RFP).

WLC had the highest fee for building the $105 million high school. The firm also has the least amount of experience in the field, has never completed a high school, and was the only firm to indicate students could not attend classes on the new campus until the 2010-2011 school year, instead of in the 2009-2010 school year. The firm was also the lowest-rated by district facilities staff scoring the proposals.

In the wake of the decision, Lundgren Management -- which had submitted the least expensive proposal -- and Barnhart Inc. -- which had the highest-rated proposal -- each sent a letter to the school district, protesting the decision.

Both had representatives at Saturday's school board meeting -- which was primarily a workshop to discuss the budgeting process for the school district -- as did the San Bernardino office of Vanir Construction Management, which had been ranked in second place in both price and as evaluated by HUSD staff.

Vanir Vice-President Dave Anderson spoke before the board, registering his company's concerns.

"We just had a concern over the selection process. We didn't think it was properly handled in terms of the final selection," Anderson said Monday. "Our hope would be that they would validate their RFP process by interviewing the top-ranked firms in each category, the top three ranked firms in each category."

Although none of the companies made a threat of imminent legal action, the letter from Barnhart's general counsel laid out a very specific and court-ready legal argument against the school board's decision to entrust the project to WLC, including a suggestion that the board had violated state government code.

Pelayes recommended that the board reconsider their decision to go with WLC. Although the board will not make a formal decision until their next meeting, Pelayes said, "the feeling that I got is that they will follow that recommendation."

The next meeting of the Hesperia Unified School District school board will be held on July 23 at 6 p.m. at Sultana High School.

them admit there wrong OMG like thats going to happen soon just wait hope we will get that soon they will walk out all 5 of them there all guilty as sin and not just 3 of them they do alot of this behind closed doors because they dont know what to do there caught and cant get out of this in anyway shape or form there BUSTED and cant handle the shame Hank Richerson is next and his awful henchmen there lies are hurtful to alot of workers and taxpayers the city has alot of exsplaining to do also to allow this to go on for so many years and do this to there own people and city shame on all of them ten years ago this would never happen but now its become nothing but greed and it has to stop the little people are suffering and the kids are getting it worse RECALL THEM NOW VOTE THEM ALL OUT.

Forgot to comment to JeB. Closed doors? Phone calls? Gatherings among THE 3? Lunches with the teachers union? Lots of openings for discussions among THE 3 for their decisions. Can we say BROWN ACT?

I thought Mr. Kirk said if he is wrong he will admit it. I haven't heard him admit he was wrong yet. All I have heard are excuses and BLAME, fault to everyone but themselves. SHAME ON THEM! Mr. Minton stated on the night that THE 3 voted to approve the construction manager and the project manager that the Board made a very irresponsible decision to make this decision. Even though he did not vote to approve. He knew at the time it was wrong. Don't lump him in with THE 3 irresponsible ones.

guess what theres a recall of the HUSD board members look at the daily press front page dont forget to vote them out there also going after hank richerdson beau you did not write the storie why not did they tell you to be quiet for a change its about time the taxpayers and parents fought back and we will win this one seems your caught too not even there attorney saw this one coming minton should go out with them he is just as guilty where one goes they all go there was no legal voteing but its in the works now.

I know Minton and H. Rogers. I have never received any special treatment for my kids. H. Rogers has no need for benefits as she is a retired teacher. Minton has no need of benefits for his family. They both believe in service to the community and thats why they do it. Not for schools for their kids.

they have a laywer on the board minton is a laywer why do they need another one to tell them what to do that makes no sence they knew what to do hartdy black playing it safe so no one got mad at him as for the others they are in it for the money roders is playing it safe too they dont want to loose there so called volenteer pay now thats a job i want if you volenteer for something get paid too its fringe benifets plus why not ask for free health insurance for life too great way of thinking on there part have the taxpayers pay for it way to go HUSD plus have your friends build the schools for you and get other cuts too everyone gets paid.

I agree with you, JeB. too bad it took a lawyer to get them to rethink their decision. Lee rogers claims to have knowledge of the construction trade, Dr. Kirk just usees the best brain he has, and then Hardy Black goes with his eerie feelings. Why not rely on the district personnel whose actual job it is to rate and compare bids? Sports is another concern I hadn't thought of. Let me just take a moment to say a huge thank you to Helen Rogers and Bruce Minton for being the voice of reason. Everyone should plan to attend the baord meeting on Monday July 23 at Sultana at six PM.

the resason the 3 board members want free health insurance for life is because they have so many kids and there well you know there religion why not have it fot the whole family it being paid for by the taxpayers braces for one kid cost almost what seven thousand dollars on avarage hospital bills who knows and being old well that can be endless there out of control hireing there friends to build schools near there homes and having there kids go to the schools most convent for them is perfect but what about for others they dont think about anyone but themselves and we and our kids are suffering now Jeb your right your kids should not have to be shuffed around what about having friends does that count for anything or bus service you just might have to drive them to school.

Another side of this are the sports programs. My sons arent stupid, but I also don't see them getting a full academic scholarship to Berkley. For the past few years they have talked about playing basketball at the Jr. High. I don't think Cedar Glen's gym will be done for their 7th grade year. Then they will be at Hesp for 9th grade and then Oak Hills for 10th - 12th. What kind of sports programs are going to be available for the kids that may use that as an opportunity to receive even a partial scholarship to a decent school?

No you can't please everyone, but if they were to use logic and be truthful then there really wouldn't be any argument as to why things are done. It would just make sense. I think I'm more bothered that it took a lawyer to point out the obvious.

Thank heavens the lawyer had a clue and I'm so glad these other construction companies raised the obvious question about a predetermined decision by the 3 board members who are determined to ruin our district. I know you can't please everyone, but our 3 new board members seem to be interested only in flexing their perceived power when they should be looking out for the best interests of our kids.

Ditto to the number of schools in the number of years! My son will have to go to Hesp High school for his freshmen year and then switch to Oak Hills, that is if it was done on time! These three school board members are too out there for the sake and safety of our kids. I don't understand why they feel they know more than the people they are paying to make these decisions. And why do our school board members need free health insurance for life or even when they are active board members? Couldn't that money be used to help kids with smaller class sizes or supplies? Hesperia High and Hesperia Junior High are taking the brunt of these stupid decisions with too many kids in such a small place and too poor of facilities. When 67percent of your campus is a portable, that does not make for quality education! I say re-vote now and move the district forward, not backward!

It occurs to me this morning that in watching the goings on since the elections, this board does not care about the kids at all. They care about political vendettas and the hidden agendas that garnered them the support to get elected. Wait til you see who the HTA is planning to run in the next election for the two other seats. It is only thanks to the dedication of so many teachers that the students are getting what they deserve.

If my calculations are right. My sons changed school to go to the 6th grade school, they will attend Ceder Glen which wont be completed. Then have to go to Hesp High as freshmen and then be moved to Oak Hills as 10th graders. While I do like the 6th grade school, thats 5 schools in 6 years. If they are for the kids, what happened to having a stable environment?

The school board members need to move forward and make decisions promoting the stability of the school district. They need to provide the best education possible for the students they serve. Isn't it financially wasteful that an attorney is needed to assist with correcting common sense issues?

How logical! I would love to know why they would chose the high bidder. Edie irwin has the right idea-the taxpayers should be at the board meetings to represent their interests. The union has their camp there and they were the ones who got The3 elected. Remember, they ran on "kids first". I'm not getting it!
